10.01 CITY CEMETERY ESTABLISHED revised 21-7-3

The cemetery is bounded on the north by Jackson Street, on the south by the existing railroad tracks and East Prairie Street, on the east by East Grace Street is established as the Marengo City Cemetery. The care, cost, and supervision of the Marengo City Cemetery, including all physical and financial matters, shall be the responsibility of the City Council and its designees who shall direct a Cemetery Board of Managers to carry out the City's objectives. The City shall have charge and control of the Marengo City Cemetery and direct the Cemetery Board of Managers to carry out the City's objectives in that regard.

10.02 Cemetery Board Of Managers Created Revised 21-7-3

The Cemetery Board of Managers is hereby created, consisting of the three existing members, serving two-year terms, each appointed by the Mayor with the advice and consent of the City Council. The Mayor shall designate the Cemetery Board of Managers chair. Members of the Cemetery Board of Managers shall select one of its members who shall keep the records in com- pliance with the Illinois Open Meetings Act. Each member shall serve a term of two years with compensation set by the City Council from time to time. Any member may be removed by the Mayor with the advice and consent of the City Council. All revenue, contributions, bequests, legacies and personal property received by the Cemetery staff or Board of Managers shall be turned over to the City Finance Director who shall account for all received.

10.03 Powers And Duties Of The Cemetery Board Of Managers

Amended, 24-4-4, 24-4-3, 21-7-3 A. MEETINGS: The Cemetery Board of Managers shall meet at such times as it may de- termine necessary to carry out the City's objectives and shall report to the Mayor and City Council no less than annually. Such meetings shall be pursuant to the Open Meetings Act. B. RECEIPTS: All funds received relating to the operation of the cemetery shall be turned over to the City for deposit into the Cemetery Fund. The Cemetery Fund shall be used for the operation of the cemetery. C. OPERATION OF CEMETERY: The Cemetery Board of Managers shall take direction from the Mayor and City Council and carry out the following: operation, maintenance, manage- ment and control the cemetery, including lot sales and services; establishment of rules for the conduct of the cemetery; determining the cost of lots and services; employment of such per- sons necessary for said operation and maintenance of the cemetery; and formulating a budget for the cemetery for City Council approval. Unless authorized by the City Council, the Ceme- tery Board of Managers shall budget to expend funds from the Cemetery Fund. All agree- ments, contracts, and other obligations relating to the cemetery shall be entered into by the City after approval. D. COMPENSATION: The Chairman and members of the Commission shall receive, as com- pensation, $50 and $30, respectively, for each attended commission meeting.
